These Terms of Use (these “Terms”) stipulate our privacy policy (this “Policy”) that describes how CotoLab. Inc. (our “Company”) processes your personal data on our services on this website (we will collectively call these our “Service”).

Article 1 (Privacy Information)

1."Personal information" in privacy information refers to "personal information" defined in the Act on the Protection of Personal Information, and is data about a living individual, including name, date of birth, addresses, phone numbers, contact information and any other data that can identify a specific individual.
2.“History and characteristic information" in privacy information refers to anything other than the "personal information" specified above, including but not limited to, services you used, products you purchased, history of pages and advertisements you visited, keywords you searched, dates and time of use, methods of use, usage environment, postal code, gender, occupation, age, IP addresses, cookie information, location information, and identification information of your devices.

Article 2 (How We Collect Privacy Information)

1.Upon signing up for our service, we may ask you for personal information such as name, date of birth, addresses, phone numbers, email addresses, bank account numbers, credit card numbers and driver's license number. We may also collect your personal transaction records and your payment information from our information providers, advertisers or advertiser clients (from now on, we call these “our partners").
2.When you are accessing or using our (including our partners’) services, we may collect your data such as services or software you used, products you purchased, history of pages and advertisements you visited, keywords you searched, dates and time of use, methods of use, usage environment (if you are using mobile devices to access or use our services, this includes connection statuses and various settings of your devices), IP addresses, cookie information, location information, and history and characteristic information including identification information of your devices.

Article 3 (Purpose of collecting and using personal information)

We collect and use your personal information for the following purposes.

(1)To let users view or modify registered information such as name, addresses, contact information and payment methods, as well as to let them view the usage of our services, purchase history of our products and payment confirmations.
(2)To send emails for updates of our services and products, and to use contact information such as names and physical addresses when we send products to users or when we need to contact them directly.
(3)To verify users using name, date of birth, addresses, phone numbers, bank account numbers, credit card numbers, driver's license number, and arrival results of certified mails.
(4)To bill users with payment information such as name and quantity of the purchased products, type, period or the number of times of the service used, billing amount, name, addresses, bank account numbers and credit card numbers.
(5)To display registered information for users to enter data easily, and to transfer data to other services (including those provided by our partners) based on the users’ instructions.
(6)To identify and blacklist users who violate the terms of use of our services, such as by delaying payments or by causing damages to third parties, and those who try to use our services for illegal or unjust purposes.
(7)To respond to inquiries from users with necessary information such as users’ billing information, usage status of our service and contact information.
(8) Any other purposes related to what are listed above

Article 4 (Provision of Personal Information to Third Parties)

1.We will not share personal information to third parties without obtaining the prior consent of users, except in the following cases. However, this excludes cases permitted by the Act on the Protection of Personal Information and other related laws and regulations.
(1) When required by laws
(2)When it is necessary to save or protect a person's life, body or property, and it is difficult to obtain the person's consent
(3)When it is particularly necessary to improve public health or promote the sound development of children, and it is difficult to obtain the consent of the individual.
(4)When it is necessary to cooperate with a national agency, a local government, or a person entrusted by them in carrying out the affairs stipulated by laws and regulations, yet there is a risk of executing the affairs by obtaining the consent of the person concerned.
(5)If the following items are notified or announced in advance; that the purpose of use includes sharing personal information to third parties, types of personal information shared to third parties, means or method of sharing personal information to third parties, stopping sharing personal information to third parties upon the request from the person concerned.
2.Regardless of the given statements of the preceding paragraph, the following cases shall not count as third parties. (1) When we outsource all or part of the handling of personal information within the scope necessary to achieve the purpose of use (2) When personal information is shared as a result of business succession due to merger or other reasons (3) When personal information is jointly used with a specific person, and that fact, the items of personal information to be jointly used, the scope of joint users, the purpose of those who use it, and the name of the person responsible for the management of the personal information are notified to the person in advance or are put in a state where the person can easily know.

Article 5 (Disclosure of Personal Information)

1.When the person requests disclosure of personal information, we will disclose it to the person without delay. However, if the disclosure falls under any of the following, we may not disclose all or part of it, and if we decide not to disclose it, we will notify you without delay. A fee of 1,000 yen will be charged for each disclosure of personal information.
(1)When there is a risk of harming the life, body, property or other rights and interests of the person or a third party
(2)When there is a risk of significant hindrance to the proper implementation of our business
(3)When there is a risk of violating laws 2. In principle, we will not disclose information other than personal information such as history and characteristic information, regardless of the given statements of the preceding paragraph.

Article 6 (Correction and Deletion of Personal Information)

1.If what we have as “personal information” is incorrect, the user can request us to correct or delete the personal information according to the procedures specified by us.
2.If we receive a request from the user as described in the preceding paragraph and determine that it is necessary to respond to that request, we will correct or delete the personal information and notify the user without delay.

Article 7 (Suspension or deletion of use of personal information)

When the person requests us to suspend or delete the use of personal information (we refer to it "suspend the use") because of the assumption that we are violating our purposes of personal information specified in Article 3 or that we are obtaining personal information in an improper way, we will conduct the necessary investigation without delay, and based on the results, we may suspend the use of personal information and notify the person to that effect. However, in cases where it is costly or difficult to suspend the use of personal information, we may take alternative measures to protect the rights and interests of the person concerned.

Article 8 (Changes to This Policy)

1.We may occasionally make changes to this Policy without notifying users.
2.Unless otherwise specified, changes to this Policy shall come into effect once they are posted on this website.
